Terms & Conditions - Customers (Fishermen)

These Terms and Conditions and any documents referred to within them, apply to all of the services we provide to customers and/or visitors who access, browse and use our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or who complete a reservation.

By using our website and our Services, you acknowledge and confirm to have read, understood and agreed to the Terms and Conditions set out below (including our Privacy Statement) and the use of cookies. Please note that these Terms and Conditions may be amended from time to time.

These pages, their content and infrastructure as well as the online platform and reservation service on and through the website are owned, operated and provided by Guide for fishing B.V. and are provided for personal, non-commercial use only, subject to the Terms and Conditions set out below.

If you do not agree to be bound by all and any of the Terms and Conditions, do not use the Platform or our Services.

Severability

Should one or more provisions of these Terms & Conditions be found to be unlawful, void or unenforceable, such provision(s) shall be deemed severable and will not affect the validity and/or enforceability of the remaining provisions of the Terms & Conditions, which will remain in full force and effect.

1. Definitions

‘Guide for fishing (‘GFF’)’, ‘we’, ‘us’, ‘our’: Guide for fishing B.V., a company incorporated under Dutch Law, having its principal office /residing in The Netherlands, Utrecht, Kees van Bohemenhof 23, and registered at the Dutch Chamber of Commerce under 67316476.

Platform’ means the website on which the Service is made available, as well as the Guide for fishing Apps and the online community.

‘Service’ means the online service through which visitors can contact Providers and through which reservations/bookings can be made, including the facilitation of payments/payment platform. ‘Service’ may also refer to the various products and services made available, listed by Providers (third parties) on the Platform.

‘Provider(s)’ means the (professional) party that provides a boat for a fishing trip and/or works as a guide on a fishing trip and/or provides an entire fishing tour/trip and/or provides any fishing related service.

‘Customer(s)’, ‘you’, ‘your’, ‘yours’ means a natural person, not acting in the course of his profession or business, who uses the Service and/or the Platform for non-commercial purposes.

‘Personal Account’ means the online personal account (Fisherman account) you create in order to access our Platform and use our Services.

2. Scope of the Services

1. Through the Platform, we provide an online solution through which Providers can advertise their products and services, which can be booked by the visitors on the Platform. By making a reservation through Guide for fishing, you enter into a direct (legally binding) contractual relationship with the Provider. From that point on, we will act solely as an intermediary between you and the Provider, transmitting the details of your reservation to the relevant Provider(s) and sending you a confirmation e-mail on behalf of the Provider.

2. When rendering our services, the information that we disclose is based on the information provided to us by the Providers. As such, Providers are fully responsible for updating all listed services and rates, availability and other information which is displayed on our Platform. Although we will use reasonable skill and care in performing our services we will not verify if all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information.

3. Each Provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our Platform. Our Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any Provider (or its facilities, venue, products or services) made available.

4. Our Service is made available for specific use -i.e. booking purposes- only. Therefore, you are not allowed to resell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, reservations, products or services available on our Platform without the consent of Guide for fishing.

3. Privacy

1. Guide for fishing respects your privacy and adheres to Dutch privacy laws. We strongly recommend you to read our Privacy Policy. If you disagree with our Privacy Policy, you cannot use our Service.

4. Personal Account (Fisherman account)

1. You may only use and access the Platform with your Personal (Fisherman) Account which contains a valid e-mail address. Your e-mail address and any other personal information you have provided with your Personal (Fisherman) Account will only be used by Guide for fishing to manage the Platform and to perform the Services. You hereby agree that the Platform may access your Personal (Fisherman) Account, may use your e-mail address and your personal information as mentioned before. You also agree that Guide for fishing may post messages on your Personal (Fisherman) Account. We like to reiterate that personal data will be processed in accordance with our Privacy Policy only.

2. You may not use or access the Platform with a Personal (Fisherman) Account in another person’s or company’s name or post messages in another person’s or company’s name. You may not impersonate any other person or company.

3. You are solely responsible for any and all activity coming from your Personal (Fisherman) Account, whether this activity was authorized by you or not. You may not use any other person's Personal (Fisherman) Account to use or access the Platform, or attempt to do so.

4. By uploading photos and/or images onto our Platform (f.i. in connection with personalising your profile or posting a review) you certify, warrant and agree that you own the copyright to the photos/images and that you agree that Guide for fishing may use the uploaded photos/images on its (mobile) website and app, in (online/offline) promotional materials and publications and as Guide for fishing at its discretion sees fit. You are granting Guide for fishing a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as Guide for fishing at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, property owners) due to Guide for fishing publishing and using these photos/images.

5. Guide for fishing does not own or endorse the photos/images that are uploaded and disclaims all responsibility and liability for the pictures posted. You warrant that uploaded photos/images do not contain any viruses, Trojan horses or infected files and do not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and do not infringe any third party rights.

6. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by Guide for fishing at any time and without prior notice.

5. Free of Charge Platform

1. The Services offered through our Platform are free of charge. We will thus not charge you for the use of our Service or add reservation fee to the prices as published on our website by Providers.
When making your payment by credit card or other methods, a handling fee may apply; please check this at time of booking.

2. To be able to use the Platform, you need to adhere to the rules as described below.

6. Platform use

1. You cannot use the Platform for any purpose that is unlawful or prohibited by these Terms and Conditions. You are responsible for complying with all local rules, laws, and regulations including, without limitation, rules about intellectual property rights, the Internet, technology, data, electronic mail, or privacy. You need to be at least 18 years old to be able to register and book a service/trip. All Customers under 18 shall be accompanied at least by an adult or cannot use our Services.

2. Any use by you of the Platform other than for private, non-commercial use is strictly prohibited. You agree not to reproduce, duplicate, copy, sell, trade, resell, distribute or exploit, any portion of the Platform, our instrumentals, use of the Platform, access to the Platform, or content obtained or available through the Platform, for any purpose other than for your personal, private, non-commercial purposes.

3. You agree not to defame, harass, abuse, threaten, stalk or defraud users of the Platform, or collect, or attempt to collect, personal information about users or third parties without their consent.

4. You agree not to intentionally interfere with or damage, impair or disable the operation of the Platform or any user's enjoyment of it, by any means, including but not limited to uploading or otherwise disseminating viruses, worms, spyware, adware or other malicious code.

5. You agree not to remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Platform, including but not limited to any features that prevent or restrict the use or copying of any accessible through the Platform, or features that enforce limitations on the use of the Platform.

6. You agree not to attempt to gain unauthorized access to the Platform, or any part of it, other accounts, computer systems or networks connected to the Platform, or any part of it, through hacking, password mining or any other means or interfere or attempt to interfere with the proper working of the Platform or any activities conducted on the Platform.

7. You agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available through the Platform. You agree neither to modify the Platform in any manner or form, nor to use modified versions of the Platform, including, without limitation, for the purpose of obtaining unauthorized access to the Platform.

8. You agree that you will not use any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Platform.
You agree not to utilize framing techniques to enclose any trademark, logo, or other content without our express written consent. You agree not to use any meta tags or any other "hidden text" utilizing the Guide for fishing' name or trademarks without our express written consent.

9. You will – if applicable - promptly remove any links that Guide for fishing finds objectionable in its sole discretion. You agree not to use any Guide for fishing logos, graphics, or trademarks as part of the link without our express consent.

10. You agree not to make unsolicited offers, advertisements, proposals, or send junk mail or spam to other users of the Platform. This includes, but is not limited to, unsolicited advertising, promotional materials or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures.

11. You agree not to reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Platform or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

7. Booking Process

1. Only registered Customers with a Personal (Fisherman) Account can book a trip/service through our Platform.

2. A registered Customer can make a direct reservation with a Provider of choice for a certain date and service. Make sure that you are well informed about the service, its whereabouts and (expected) duration, gear or equipment requirements and any other essentials and specifics before booking.

3. When making the reservation, you need to pay 100% of the booking value as advance payment. Payments are made through a platform hosted by a third party, i.e. Mollie B.V. Please note that Mollie B.V. applies its own Terms and Conditions regarding the payment procedure.

4. All booking requests will be transmitted to the Provider of your choice, who needs to confirm booking requests.

5. Your booking will be viewed as final only after confirmation of the Provider.

6. Guide for fishing will confirm the booking on behalf of the Provider and provide you with all the necessary details, such as the phone number of the guide.

7. If your booking cannot be confirmed due to unavailability or any other reason,

  • The Provider might offer alternative dates and you can reschedule the booking within the Guide for fishing system, or

  • Guide for fishing will refund your prepayment in its entirety within 14 working days.

8. Pricing and payment

1. The Providers pay a facilitation fee for us as compensation for facilitating the bookings. The rates displayed on the Website contain already our facilitation fee and all local taxes, fees – if applicable.

2. The price of the services will be as quoted on the Website, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted by our Providers.

3. Despite our best efforts, some of the Services listed on the website may be incorrectly priced.

WE EXPRESSLY RESERVE THE RIGHT TO CORRECT ANY PRICING ERRORS ON OUR WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH EVENT, IF AVAILABLE, WE WILL OFFER YOU THE OPPORTUNITY TO KEEP YOUR PENDING RESERVATION AT THE CORRECT PRICE OR WE WILL CANCEL YOUR RESERVATION WITHOUT PENALTY.

4. A final price will be indicated prior to your booking being paid and confirmed. Errors are rare but can occur in the pricing system and these cannot be honoured.

5. We are under no obligation to provide Services to you at an incorrect (lower) price, even after you have been sent confirmation of your booking.

6. All prices displayed on the Website are in Euros (€), unless explicitly stated otherwise.

7. In accordance with article 7.3 of these Terms and Conditions, you will be required to pay the total sum of the service upfront to finalise your booking, unless (individually and) expressly otherwise agreed. If the prepayment cannot be collected, article 8.5 of these Terms and Conditions will apply.

8. Guide for fishing retains the right to commence any booking process only until one (1) business day after our payment processor confirms your payment. You agree that we are not responsible for any failure of our payment processor to remit payment to us that you may make through them, or any failure on their part to notify us of payment, and that in such cases, it is your duty to resolve the matter directly with our payment processor before we will acknowledge any payment by you.

9. All payments must be processed successfully. If, however, you do not complete the payment procedure, all monies processed will be forfeited, and your booking will be cancelled.

10. When making your payment by credit card or other methods, a handling fee may apply; please check this at time of booking.

9. Cancellation and no-show

1. It is the Providers responsibility to define a cancellation policy for each service listed. Please note, that one Provider can define different cancellation policy for different provided services, and that certain services are not eligible for cancellation or change.

2. Since you enter into a direct contractual relationship with a Provider, the Provider’s cancellation and no-show policy shall apply to your booking as well as any additional (delivery) terms and conditions of the Provider that may apply to your booking (including the relevant house rules, safety provisions of the Provider). Note that you may also be subject to terms and conditions of an accommodation provider (if applicable) for services rendered and/or products offered by the accommodation provider.

3. Guide for fishing is not responsible for any incidental expenses or consequential losses that the Customer may have incurred as a result of the cancelled booking such as visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, etc. Please note that certain rates or special offers are not eligible for cancellation or change.

4. If your booking has to be cancelled by the Provider prior to departure due to unsafe weather conditions or any other reason, you shall -without prejudice to the Providers’ terms and conditions- have the choice of:

  • A full refund of deposit paid for the cancelled service.

  • A substitute service(s) of equivalent value, where such substitute is reasonably available; or

  • A substitute service(s) of lower value if no service(s) of equivalent value is reasonably available, and to recover the difference in deposit between the deposit of the service originally purchased and that of the substitute one.

5. In the event of no-show or cancellation on behalf of the Customer, the cancellation/no-show policy of the Provider and service will be applicable. Please check the Providers’ details thoroughly for any such conditions prior to making your reservation.
In case of no-show, Guide for fishing cannot offer you a refund. If the booking was cancelled by you (it was possible based on the cancellation policy of the service), you will get a refund of deposit paid for the cancelled service. If applicable, the handling fee of your chosen payment method (in accordance with article 8.10 of these Terms and Conditions) will not be refunded.

6. Note that a reservation will be cancelled -without prior notice of default or warning- if the prepayment cannot be collected. Late payment, wrong bank, debit or credit card details, invalid credit/debit cards or insufficient funds are for your own risk and account and you shall not be entitled to any refund of any (non-refundable) prepaid amount unless the Provider agrees or allows otherwise under its (pre)payment and cancellation policy.

7. You may cancel or change your prepaid booking in accordance with the individual Provider’s selected cancellation policy. Please note that you may be charged for your cancellation in accordance with the Provider’s cancellation policy. We recommend that you read the cancellation policy of the Provider carefully prior to making a reservation.

8. You must show-up at the precise time and location specified in the confirmation e-mail or as pre-agreed with the Provider. If you have a late or delayed arrival on the check-in date or only arrive the next day, make sure to timely/promptly communicate this to the Provider so they know when to expect you to avoid cancellation of your reservation. Guide for fishing does not accept any liability or responsibility for the consequences of your delayed arrival or any cancellation fee. In case of no-show, we cannot offer you a refund.

9. Please note that Providers have the ultimate responsibility for the safety of the crew and the people onboard. If a trip/service is no longer safe due to any reason, the Provider has the right to cancel the whole trip/service or a part thereof (before or after departure).

10. Guide for fishing does not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise, of Providers in connection with your trip/service pursuant to a contract between them and yourselves. We do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of Government, force of nature or of any other authorities, accidents to or failure of machinery or equipment or industrial action.

10. (Further) Correspondence and Communication

1. You will receive e-mail notifications during and after the booking process (e.g. confirmation of booking or request to add a review for past booking). The booking process can be tracked in your Personal (Fisherman) account as well at any time.
We may also provide you with certain information and offers (including third party offers) relevant to you, if you opt to receive our newsletter. Please see our Privacy Policy for more information about how we may contact you.

2. Guide for fishing disclaims any liability or responsibility for any communication with the Provider on or through its platform. You cannot derive any rights from any request to, or communication with the Provider or (any form of) acknowledgement of receipt of any communication or request. Guide for fishing cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed or accepted by the Provider.

3. In order to duly complete and secure your reservation, you need to use your correct e-mail address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled e-mail address or inaccurate or wrong (mobile) phone number or any other data.

4. Any claim or complaint against Guide for fishing or in respect to the Service must be promptly submitted, but in any event within 30 days after the scheduled day of consummation of the product or service (e.g. check-out date). Any claim or complaint that's submitted after the 30-day period may be rejected, and the claimant shall forfeit their right to any (damage or cost) compensation.

11. Disclaimer

1. Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our Services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation e-mail (whether for one event or series of connected events).

2. However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the Platform and its contents shall be liable for:

(i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim;

(ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Provider or any other article or content as made available on our Platform;

(iii) the services rendered or the products offered by the Provider or other business partners;

(iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform; or

(v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

3. Guide for fishing is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (reservation) price to the relevant tax authorities. Guide for fishing does not act as the merchant of record for any product or service made available on the Platform.

12. Intellectual Property

1. Unless stated otherwise, the software required for our services or available on or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by Guide for fishing B.V., its suppliers or providers.

2. Guide for fishing exclusively retains ownership of all rights, title and interest in and to all intellectual property rights of the look and feel (including infrastructure) of the Platform on which the Service is made available (including the guest reviews and translated content).

3. You are not allowed to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Guide for fishing. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

13. Miscellaneous

1. When booking through Guide for fishing, you agree to take up adequate insurance for yourself and any other person in your company, including infants and children. Some activities may be considered to be hazardous and require additional coverage – please check with your insurance vendor. We cannot accept responsibility for any costs you incur as a result of not being adequately insured.

BY OFFERING SERVICES TO PARTICULAR INTERNATIONAL DESTINATIONS, GUIDE FOR FISHING DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

2. These Terms and Conditions and the provision of our Services shall be governed by and construed in accordance with Dutch law. Any dispute arising out of these Terms and Conditions or/and our Services shall exclusively be submitted to the competent courts in Utrecht, the Netherlands.

3. The original English version of these Terms and Conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these terms and conditions or inconsistency or discrepancy between the English version and any other language version of these terms and conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on our Platform (by selecting "English” language) or shall be sent to you upon your written request.

1. Guide for fishing respects your privacy as well as the privacy of Customers. We adheres to Dutch privacy laws. We strongly recommend you to read our Privacy Policy. If you disagree with our Privacy Policy, you cannot use our Service.

4. Provider Account

1. You may only use and access the Platform with your Provider Account which contains a valid e-mail address. Your e-mail address and any other company and/or personal information you have provided with your Account will only be used by Guide for fishing to manage the Platform and to perform the Services. You hereby agree that the Platform may access your Provider Account, may use your e-mail address and your company and/or personal information as mentioned before. You also agree that Guide for fishing may post messages on your Provider Account. We like to reiterate that personal and company data will be processed in accordance with our Privacy Policy only.

2. In order to complete your Account, you agree to provide us with company details such as VAT number, bank details, company address, Chamber of Commerce number - if applicable. If you do not own a company, please provide us with your full personal data, including a telephone number and bank details.

3. You may not use or access the Platform with an Account in another person’s or company’s name or post messages and Tracks in another person’s or company’s name. You may not impersonate any other person or company.

4. You are solely responsible for any and all activity coming from your Provider Account, whether this activity was authorized by you or not. You may not use any other person's or company’s Account to use or access the Platform, or attempt to do so.

5. By uploading photos and/or images onto our Platform you certify, warrant and agree that you own the copyright to the photos/images and that you agree that Guide for fishing may use the uploaded photos/images on its (mobile) website and app, in (online/offline) promotional materials and publications and as Guide for fishing at its discretion sees fit. You are granting Guide for fishing a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as Guide for fishing at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, property owners) due to Guide for fishing publishing and using these photos/images.

6. Guide for fishing does not own or endorse the photos/images that are uploaded and disclaims all responsibility and liability for the pictures posted. You warrant that uploaded photos/images do not contain any viruses, Trojan horses or infected files and do not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and do not infringe any third party rights.

7. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by Guide for fishing at any time and without prior notice.

5. Service fees

1. The Services offered through our Platform are free of charge for Customers, to make sure our Platform can be easily accessed and Customers can get in touch with a Provider of choice.
Only when Customers make their payment by credit card or other methods, a handling fee may apply.

2. You -as Provider- can sign up for free. In case of a successful booking, Guide for fishing will charge a fee of 12% + VAT of the booking value. For this fee, Guide for fishing offers you an easily accessible online Platform, marketing activities and an opportunity to expand your business.

3. Our fee will be deducted from the booking value before transferring it to you. Your share of the booking value will be transferred to you after you provided, delivered the service.

4. You – as a Provider – will provide us with a correct bank account number in IBAN format, in order for us to transfer your share of the booking value to you.

6. Platform use

1. In order for you to use the Platform, you need to adhere to the rules as described below. If you object to any of these rules, please do not use our Services.

2. You will not use the Platform for any purpose that is unlawful or prohibited by these Terms and Conditions. You are responsible for complying with all local rules, laws, and regulations including, without limitation, rules about intellectual property rights, the Internet, technology, data, electronic mail, or privacy.

3. Any use by you of the Platform other than described above, is strictly prohibited. You agree not to reproduce, duplicate, copy, sell, trade, resell, distribute or exploit, any portion of the Platform, our instrumentals, use of the Platform, access to the Platform, or content obtained or available through the Platform, for any purpose other than for your personal, private purposes.

4. You agree not to defame, harass, abuse, threaten, stalk or defraud users of the Platform, or collect, or attempt to collect, personal information about users or third parties without their consent.

5. You agree not to intentionally interfere with or damage, impair or disable the operation of the Platform or any user's enjoyment of it, by any means, including but not limited to uploading or otherwise disseminating viruses, worms, spyware, adware or other malicious code.

6. You agree not to remove, circumvent, disable, damage or otherwise interfere with any security-related features of the Platform, including but not limited to any features that prevent or restrict the use or copying of any accessible through the Platform, or features that enforce limitations on the use of the Platform.

7. You agree not to attempt to gain unauthorized access to the Platform, or any part of it, other accounts, computer systems or networks connected to the Platform, or any part of it, through hacking, password mining or any other means or interfere or attempt to interfere with the proper working of the Platform or any activities conducted on the Platform.

8. You agree not to obtain or attempt to obtain any materials or information through any means not intentionally made available through the Platform. You agree neither to modify the Platform in any manner or form, nor to use modified versions of the Platform, including, without limitation, for the purpose of obtaining unauthorized access to the Platform.

9. You agree that you will not use any robot, spider, scraper, or other automated means to access the Platform for any purpose without our express written permission or bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Platform.

10. You agree not to utilize framing techniques to enclose any trademark, logo, or other content without our express written consent. You agree not to use any meta tags or any other "hidden text" utilizing the Guide for fishing's name or trademarks without our express written consent.

11. You will promptly remove any links that Guide for fishing finds objectionable in its sole discretion. You agree not to use any Guide for fishing logos, graphics, or trademarks as part of the link without our express consent.

12. You agree not to make unsolicited offers, advertisements, proposals, or send junk mail or spam to other users of the Platform. This includes, but is not limited to, unsolicited advertising, promotional materials or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures.

13. You agree not to reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Platform or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.

Use the Website or Guide for fishing Services in any manner that could disable, overburden, damage, or impair the site or interfere with any other party’s use of the Website or the Guide for fishing Products or Services, including their ability to engage in real time activities through the Website or our Products and/or Services.

15. Use any robot, spider, or other automatic device, process, or means to access the Website for any purpose, including monitoring or copying any of the material on the Website.

16. Use any manual process to monitor or copy any of the material on the Website or for any other unauthorized purpose without our prior written consent.

17. Use any device, software, or routine that interferes with the proper working of the Website.

18. Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

19. Attempt to gain unauthorized access to, interfere with, damage or disrupt any parts of the Website, the server on which the Website is stored, or any server, computer, or database connected to the Website.

20. Attack the Website or Guide for fishing Products or Services via a denial-of-service attack or a distributed denial-of-service attack.

21. Access, tamper with, or use non-public areas of the Website, computer systems, or its delivery processes.

22. Probe, scan, or test the vulnerability of any system or network or breach or circumvent the security or authentication measures.

23. Access or search or attempt to access or search the services by any means other than those specifically provided by Guide for fishing.

24. Forge any TCP/IP header in any e-mail or posting, or in any way use the Guide for fishing Products or Services to send altered, deceptive, or false source-identifying information.

25. Interfere with or disrupt the access of any Customer or Provider.

26. Otherwise attempt to interfere with the proper working of the Website.

7. Provider Requirements

1. As a Provider, you may create fishing related services, trips. To create one, you will be asked a variety of questions. You acknowledge and agree that you alone are responsible for any and all content you post related to any service, trip.

2. Accordingly, you represent and warrant that any service, fishing trip you post and the booking of, or a Customer’s experience with a service, fishing trip you create will not breach any agreements you have entered into with any third parties, and will (i) be in compliance with all applicable laws (such as maritime laws and laws governing boats, bodies of water, etc.), tax requirements, intellectual property laws, and rules and regulations that may apply to any service, fishing trip you post (including having all required permits, licenses, and registrations), and (ii) not conflict with the rights of third parties.

3. Please note that Guide for fishing assumes no responsibility for a Provider’s compliance with any agreements with or duties to third parties, applicable laws, rules, and regulations. We reserve the right, at any time and without prior notice, to remove or disable access to any service, trip for any reason, including ones that Guide for fishing, in its sole discretion, considers to be objectionable for any reason, in violation of this Agreement or Guide for fishing then-current policies, or that are otherwise harmful to the Website, the Platform, Guide for fishing, or its Customers.

4. As a Provider, you understand and agree that Guide for fishing does not act as an insurer or as your contracting agent. If a Customer requests a booking of your service, fishing trip, any agreement you enter into with such Customer is between you and the Customer and Guide for fishing is not a party to it.

5. Guide for fishing strongly recommends that Providers obtain insurance for their services, fishing trips. Please review any insurance policy that you may have for your service, fishing trip carefully and ensure that you are familiar with and understand any exclusions to, and any deductibles that may apply for, such insurance policy, including, without limitation, whether or not your insurance policy will cover the actions or inactions of Customers while on the trip.

8. No Endorsement

1. Guide for fishing does not endorse any Provider, Customer, or listing. Although Providers and Customers are required by this Agreement to provide accurate information, Guide for fishing does not make any representations about, confirm, or endorse any Provider, Customer, or any Provider’s or Customer’s purported identity or background.

2. By using the Website and our Services, you agree that any legal remedy or liability that you seek to obtain for actions or omissions of other Providers or Customers or other third parties will be limited to a claim against the particular Provider or Customer or other third party who caused you harm. You agree not to attempt to impose liability on or seek any legal remedy from us with respect to such actions or omissions.

9. Prohibited Uses

1. You may use the Website and the Guide for fishing Products and Services only for lawful purposes and in accordance with these Terms and Conditions and any further Agreements we may have with you. You agree not to use the Website or the Guide for fishing Products and Services:

  • In any way that violates any applicable local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the EU or other countries).

  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information or otherwise.

  • To transmit, or procure the sending of any “junk mail,” “chain letter,” or “spam” or any other similar solicitation.

  • To impersonate or attempt to impersonate Guide for fishing, a Guide for fishing employee, another user or any other person or entity (including, without limitation, by using e-mail addresses or user screen names associated with any of the foregoing).

  • To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Website, or which, as determined by us, may harm Guide for fishing or users of the Website or expose them to liability.

2. You expressly agree NOT to bypass our Website, the Platform or any of the Services we offer. Renegotiating prices directly with Customers is prohibited.

3. We reserve the right to suspend/cancel your account and registration at any time, in our sole discretion, in case of bypassing our Platform.

10. Pricing

1. You agree to pre-negotiate service/trip prices with Guide for fishing to facilitate the booking of services, trips with you/your company. The rate we display on the Website is a combination of the pre- negotiated rate with you and the facilitation fee (12%+VAT of the booking value) retained by us to compensate us for our Services. We retain our fees as compensation in servicing and facilitating bookings.
A minimum price for certain service types might be determined by us in our sole discretion.

2. The price of the services, trips will be as quoted on the Website, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect bookings already accepted by our Customers.

3. Despite our best efforts, some of the Services listed on the Website may be incorrectly priced.

WE EXPRESSLY RESERVE THE RIGHT TO CORRECT ANY PRICING ERRORS ON OUR WEBSITE AND/OR ON PENDING RESERVATIONS MADE UNDER AN INCORRECT PRICE. IN SUCH EVENT, IF AVAILABLE, WE WILL OFFER CUSTOMERS THE OPPORTUNITY TO KEEP THEIR PENDING RESERVATION AT THE CORRECT PRICE OR WE WILL CANCEL A RESERVATION WITHOUT PENALTY.

4. All prices displayed on the Website are in Euros (€), unless explicitly stated otherwise.

11. Booking Process

1. Only registered Customers with a Personal (Fisherman) Account can book a trip/service through our Platform.

2. A registered Customer can make a direct reservation with a Provider of choice for a certain date and service. Customers need to pay 100% of the booking value as advance payment. Payments are made through a platform hosted by a third party, i.e. Mollie B.V. Please note that Mollie B.V. applies its own Terms and Conditions regarding the payment procedure.

3. After receiving the Customer’s advance payment, the booking request will be transmitted to you as a Provider. You need to confirm booking requests within 24 hours.

4. A booking will be finalised after your confirmation.

5. Guide for fishing will confirm the booking to both you and the Customer and provide you with all the necessary details.

12. Cancellation and no-show

1. For each listed service you can define a cancellation policy in our Platform. You must choose from our pre-defined options, which you can see in your Provider account. This cancellation policy applies for all bookings in our Platform, for a given service. You can define different cancellation policies, if you list more services.

2. Since you enter into a direct contractual relationship with a Customer, you may apply additional (delivery) terms and conditions (including the relevant house rules and safety procedures), to the extent they do not conflict with the provided information in your external profile and in the service description, these Terms and Conditions or any statutory regulations. You must be always clear, specific and you must include all major terms, when you describe your services on our Platform.

3. Guide for fishing is not responsible for any incidental expenses or consequential losses that you may have incurred as a result of the cancelled booking, such as loss of earnings, loss of profits, loss of contracts, administrative expenses and any other futile efforts in connection with a cancelled booking.

4. If a booking has to be cancelled by you prior to departure due to unsafe weather conditions or other reason, the Customer shall -without prejudice to your terms and conditions- have the choice of:

  • A full refund of deposit paid for the cancelled service.

  • A substitute service(s) of equivalent value, where such substitute is reasonably available; or

  • A substitute service(s) of lower value if no service(s) of equivalent value is reasonably available, and to recover the difference in deposit between the deposit of the service originally purchased and that of the substitute one.

5. Customers are under the obligation to timely inform directly you about any delays. Our Customer Service department strives to contact you promptly, provided we receive such information. Guide for fishing does not accept any liability or responsibility for the consequences of delayed arrival or any cancellation.

6. Please note that you have the ultimate responsibility for the safety of the crew and the people (onboard). In the event that the service/trip is no longer safe due to any reason, you retain the right to cancel the whole service/trip or a part thereof (before or after departure). Please inform our Customer Service Department promptly about any such decisions by adding status for all provided bookings.
If you need to cancel a service/trip due to safety reasons, you must immediately contact your customers via phone and inform them, especially if you need to cancel last-minute your service.

7. Guide for fishing does not accept any liability of whatever nature for the acts, omissions or default, whether negligent or otherwise, of Providers in connection with your service/trip pursuant to a contract between yourselves and the Customers. We do not accept liability in contract or in tort (actionable wrong) for any injury, damage, loss, delay, additional expenses or inconvenience caused directly or indirectly by force or other events which are beyond our control, or which are not preventable by reasonable diligence on our part including, but not limited to war, civil disturbance, fire, floods, unusually severe weather, acts of Government or of any other authorities, accidents to or failure of machinery or equipment or industrial action.

13. (Further) Correspondence and Communication

1. Your will receive e-mail notifications during and after the booking process (e.g. booking request or about your reviews). The booking process can be tracked in your Provider account as well any time. We may also provide you with certain information and offers (including third party offers) relevant to your company and/or business, if you opt to receive our newsletter. Please see our Privacy Policy for more information about how we may contact you.

2. The Customer will receive an e-mail notification during the booking process, after you confirm a booking request. Customers may also receive information about you/your company (e.g. your phone number).

3. Guide for fishing disclaims any liability or responsibility for any communication with the Customer on or through its platform. You cannot derive any rights from any request to, or communication with the Customer or (any form of) acknowledgement of receipt of any communication or request. Guide for fishing cannot guarantee that any request or communication will be (duly and timely) received/read by, complied with, executed or accepted by the Customer.

4. In order to duly complete and secure a booking, you need to use a correct e-mail address. We are not responsible or liable for (and have no obligation to verify) any wrong or misspelled e-mail address or inaccurate or wrong (mobile) phone number or any other data.

5. Any claim or complaint against Guide for fishing or in respect to the Service must be promptly submitted, but in any event within 30 days after the scheduled day of consummation of the product or service (e.g. check-out date). Any claim or complaint that's submitted after the 30-day period may be rejected, and the claimant shall forfeit their right to any (damage or cost) compensation.

14. Disclaimer

1. Subject to the limitations set out in these Terms and Conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation e-mail (whether for one event or series of connected events).

2. However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for:

(i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim;

(ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of Providers or any other article or content as made available on our Platform;

(iii) the services rendered or the products offered by the Provider or other business partners;

(iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Platform; or

(v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

3. Guide for fishing is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the (reservation) price to the relevant tax authorities. Guide for fishing does not act as the merchant of record for any product or service made available on the Platform.

4. Under no circumstance Guide for fishing shall be considered as an employer. We offer our intermediary services and the usage of our Platform solely as an opportunity to expand your business in exchange for our facilitation fee.

15. Intellectual Property

1. Unless stated otherwise, the software required for our services or available on or used by our Platform and the intellectual property rights (including the copyrights) of the contents and information of and material on our Platform are owned by Guide for fishing B.V., its suppliers or providers.

2. Guide for fishing exclusively retains ownership of all rights, title and interest in and to all intellectual property rights of the look and feel (including infrastructure) of the Platform on which the Service is made available (including the guest reviews and translated content).

3. You are not allowed to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the Platform or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to Guide for fishing. Any unlawful use or any of the aforementioned actions or behaviour will constitute a material infringement of our intellectual property rights (including copyright and database right).

16. Miscellaneous

1. When offering services/trips through Guide for fishing, you agree that you/your company/your equipment is adequately insured. For activities that may be considered to be hazardous, you are obliged to take up additional coverage. You should always be able to submit an authenticated copy of insurance policies and proof of payment of the premiums upon request. We cannot accept responsibility for any costs you incur as a result of not being adequately insured.

BY FACILITATING SERVICES TO PARTICULAR INTERNATIONAL DESTINATIONS, GUIDE FOR FISHING DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH PLACES IS ADVISABLE OR WITHOUT RISK, AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

2. These Terms and Conditions and the provision of our Services shall be governed by and construed in accordance with Dutch law. Any dispute arising out of these Terms and Conditions or/and our Services shall exclusively be submitted to the competent courts in Utrecht, the Netherlands.

3. The original English version of these Terms and Conditions may have been translated into other languages. The translated version is a courtesy and office translation only and you cannot derive any rights from the translated version. In the event of a dispute about the contents or interpretation of these Terms and Conditions or inconsistency or discrepancy between the English version and any other language version of these Terms and Conditions, the English language version to the extent permitted by law shall apply, prevail and be conclusive. The English version is available on our Platform (by selecting "English” language) or shall be sent to you upon your written request.
